Under Colorado law, domestic violence isn't a charge in and of itself. It is actually a sentencing upgrade that can be added to nearly any other crime. With regards to spousal battery, Colorado law defines participants involved in domestic assault as having now or in the past an “intimate relationship”:
“A relationship between spouses, former spouses, past or present unmarried couples, or persons who are both the parents of the same child regardless of whether the persons have been married or have lived together at any time.” CRS 18-6-800
