Sexual assault allegations arise in a variety of different scenarios, from an interaction with a stranger to a long term married couple. However, most accusations happen within the context of an existing relationship. When a sexual assault charge is made, both parties involved are adults.
With our years of experience handling sex crimes and sexual assault cases, we see that often times alcohol is at play. A common scenario is that the next day when reality settles in, the alleged victim claims they refused to give consent the night before.
Many times, our defense hinges on consent, so understanding what it is and isn't is crucial to most cases. With regards to consent, Colorado law has clear definitions:
“Consent” means cooperation in act or attitude pursuant to an exercise of free will and with knowledge of the nature of the act. A current or previous relationship shall not be sufficient to constitute consent under the provisions of this part 4. Submission under the influence of fear shall not constitute consent. Nothing in this definition shall be construed to affect the admissibility of evidence or the burden of proof in regard to the issue of consent under this part 4" CRS 18-3-401
Regardless of your situation, let us help. Do not take your sexual assault charge lightly because your future is at stake. You can be locked up, lose the ability to see your children, and be put on the sex offender list indefinitely.
