DUI (driving under the influence of alcohol or drugs) is a more serious charge than DWAI (driving while ability impaired). If the arresting officer doesn’t find any physical evidence of drugs or alcohol in the car but suspects that you’ve consumed something, a DWAI may be charged instead.
Normally, a breathalyzer or blood test determines whether you will be charged with a DWAI or DUI. You will incur a DWAI if your blood alcohol content (BAC) is more than 0.05 but less than Colorado’s legal limit set at 0.08. If your BAC is 0.08 or higher, most likely you will get a DUI.
A DUI arrest results in two separate legal processes: a criminal case and a license revocation hearing through the Colorado Department of Motor Vehicles. If during the arrest you refused a breathalyzer or blood test, you only have 7 days from the date you were arrested to arrange a hearing with the DMV. If no hearing is scheduled, you will automatically lose your license for up to a year.
Under Colorado law, police must have probable cause to pull you over. So what is probable cause? The office must see common signs that the drive is under the influence of drugs or alcohol: not braking at intersections, erratically slowing down and speeding up, swerving into different lanes of traffic.
