Colorado Springs Drug Possession and Sales Defense Attorneys
Facing any sort of drug charge is extremely serious, but it becomes much more grave when you move from mere possession to possession and sales.
Some may think that possession with intent to sell doesn’t mean the same thing as possession and sales. However, the courts look at it the same and the penalties are just as severe.
Prosecution determines your intent by investigating your actions after you had possession of the drug. Were the drugs separated into small portions, ready to sell in lesser quantities? Were you in possession of a scale or large amounts of cash at the time of arrest? If this and/or other circumstances are true, there’s a very good chance that the courts will know that the drugs were not intended solely for personal use.
In general, the type of drug that you possess and sell will have different consequences, based on how harmful the drug is. The classifications are known as schedules and are broken down as follows:
Schedule 1: These drugs have a high risk of dependency and there is no acceptable use, including medicinally. The main schedule 1 drug is heroine.
Schedule 2: Opium and Cocaine are the most popular schedule 2 drugs, and while they still run a high risk of dependency, there are some medical use allowances.
Schedule 3: With a moderate risk of addiction, codeine and steroids fall into a schedule 3 category.
Schedule 4: These substances are widely accepted for medical use and range from clonazepam to sedatives.
Schedule 5: With almost no potential for abuse, over the counter medications make up the majority of this category.
For possession with intent to sell, you’ll most likely be looking at a Class 3, 4 or 5 felony. Drug penalties for felony charges are no joke and can result in up to 32 years in prison, depending on the class of circumstance surrounding your situation.
